The Importance of Independent Legal Advice
And Home Reports

Hardly a day goes by without hearing or reading of the bad publicity Spain receives in reference to people being sold illegal properties. Sadly for many following their dream to a better lifestyle becomes a personal nightmare, as they have not bought what they have been sold, therefore being robbed of hundreds of thousands of pounds by unethical practices of having been given inappropriate advice.
There is however a way to prevent this happening by asking if there is a Home Report available. This is why it is very important to employ the services of an independent Lawyer. This avoids difficult and costly situations from arising. If the house you want to purchase is without a report it is advisable to have one done whether you are buying privately, through an estate agent or a developer. It is an inexpensive way to ensure your safety and to make certain your rights are upheld

A Home Reports consist of 5 important checks and these are as follows;

  • To make certain all information is detailed and accurate. It is vitally important to make sure the address, square meters, distribution and services do not differ from the legal description contained in the property register.
  • Information of what the law requires in reference to taxes. Taxes have to be up to date and paid by the Vendor and the purchase has to be entered into a public document at the Notaries office where you sign.
  • To make you aware of the classification of the land the house is situated on. This has to be done by the Independent Lawyer visiting the town hall and studying the land registry as there are different rules and laws depending on the classification.
  • Information that has to be obtained from the vendors. This consists of the community taxes making certain they are all paid.
  • Being present when you go to sign at the Notary Office. Normally the estate agent will prepare the contract for both parties to sign. This is why it is so important to have independent legal representation to validate that the buyer's rights are upheld and to confirm everything is correct.


If each one of the above steps is followed and all are correct then there will be no problems in registering the property into the new owner's name. This also enables the independent Lawyer to arrange mortgages on request.

Another very important point for foreigners buying homes or starting businesses here in Spain is the NIE number. This has to be applied for in person, it should never be done on your behalf.
